This Website Privacy Policy applies to personal information collected by HEVEN Management Services Pty Ltd and its Australian related bodies corporate operating under the HEVEN brand (together, “HEVEN”, “we”, “us” or “our”).

It applies to information collected through www.heven.com.au, other websites operated by HEVEN and communications arising from your use of those websites.

This policy explains what personal information we collect, why we collect it, how we use and disclose it, and how you may access, correct or complain about our handling of it.

We intend to handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

HEVEN provides business advisory and consultancy services and may connect business owners with investors, lenders, advisers and other capital or transaction partners. This policy does not replace any additional privacy notice provided in connection with a particular client engagement, investment opportunity or transaction.

2. Personal information we collect

The personal information we collect depends on how you interact with us and may include:

  • your name, company, position and contact details;
  • information included in an enquiry, application, expression of interest or meeting request;
  • information you provide when subscribing to updates, downloading material, attending an event or communicating with us;
  • information about your business, investment interests, funding needs or proposed opportunity, to the extent it identifies you or another individual;
  • records of our correspondence and interactions with you;
  • identification, financial or eligibility information where reasonably required for an engagement, transaction or investment opportunity; and
  • technical information such as your IP address, browser and device type, operating system, referring page, pages viewed and the dates and times you access our website.

You do not have to provide personal information. However, if you do not provide information we request, we may be unable to respond to your enquiry, provide requested information, assess your interest or arrange an introduction.

We generally collect personal information directly from you when you:

  • subscribe to communications;
  • request or download information;
  • contact us by email or telephone;
  • book a meeting;
  • attend an event; or

  • any AFS licensee or authorised representative through which HEVEN provides regulated services, where applicable;
  • website hosting, cloud storage, CRM, analytics, communications, marketing and administrative service providers;
  • prospective investors, lenders, advisers or transaction partners where you have requested or authorised an introduction;
  • a person acting on your behalf;
  • organisations involved in a proposed or completed business transaction; and
  • regulators, courts, law-enforcement bodies or other persons where required or permitted by law.

We do not sell personal information as a standalone commercial asset.

Where practicable, we will obtain your authority before sharing information that identifies you or your business with a prospective investor, lender or transaction partner.

Opting out of marketing will not prevent us from sending communications necessary to respond to an enquiry, manage a meeting, provide a service or administer a transaction.

Some HEVEN personnel and service providers may be located outside Australia. We are currently likely to disclose personal information to recipients in the Philippines and the United States.

We may also disclose personal information to an overseas investor, lender, adviser or transaction partner where you request or authorise an introduction.

Where required by law, we will take reasonable steps to ensure overseas recipients handle personal information consistently with the Australian Privacy Principles.

Material changes to the countries in which recipients are likely to be located will be reflected in an updated version of this policy or a relevant collection notice.
